These General Terms and Conditions of Sale (hereinafter GTCS) aim to govern the contractual relationship between the company Saranguerel (hereinafter the Merchant) and any person wishing to make a purchase (hereinafter the Customer) on the website https://saranguerel.com (hereinafter the "Website name").
For any questions regarding the GTCS or the Privacy Policy, the Customer can contact customer service at the following email address: saranguerel@saranguerel.com
By using https://saranguerel.com or by placing an order through it, the Customer agrees to be bound by these GTCS and the Privacy Policy, without restriction or reservation.
Before placing an order, the Customer must tick the box "I acknowledge that I have read and accepted the General Terms and Conditions of Sale and the Privacy Policy".
The cancellation of a clause of the GTCS will not affect the validity of the GTCS as a whole.
The Merchant reserves the right to modify these GTCS at any time, with any modifications taking effect upon their publication on https://saranguerel.com. The new GTCS will apply to any new order.
The content of the website https://saranguerel.com (logos, texts, trademarks, images, videos) is the intellectual property of the Merchant. Any reproduction, in whole or in part, is prohibited without the express prior authorization of the Merchant.
All orders on https://saranguerel.com are subject to product availability. In case of unavailability after an order has been placed, the order will be cancelled and the Customer will be notified at the email address provided by the Customer for placing their order. The Merchant reserves the right to remove its products from https://saranguerel.com or to modify any information or illustration at any time.
The description of the products on https://saranguerel.com does not constitute a contractual document. The Merchant cannot therefore be held liable for any differences that do not affect their essential characteristics.
The prices displayed on https://saranguerel.com are indicated in EUR € but do not include delivery costs. Delivery costs will therefore be added to the total amount due by the Customer, in accordance with Article 7.
The Merchant reserves the right to modify its prices at any time. In this case, price changes will only apply to future orders and not to orders already in progress.
In case of a pricing error, the Merchant reserves the right to correct it and will inform the Customer as soon as possible via the email address they provided, in order to offer them the option of completing the transaction at the correct price or cancelling the order.
Subject to availability (see article 5 above), the Merchant undertakes to deliver the Customer's order within 30 days from the order confirmation received at the email address provided by the Customer.
It is the Customer's responsibility to check the condition of their products and the conformity of their order upon delivery.
When placing an order, it is up to the Customer to choose their preferred delivery method from those offered on https://saranguerel.com. Delivery costs can be found on the carriers' websites.
The available payment methods are those listed on https://saranguerel.com.
The Merchant reserves the right to modify this list at any time, without affecting current orders.
By placing an order on https://saranguerel.com, the Customer guarantees to be at least 18 (eighteen) years old and to be legally capable of entering into a contract.
The Customer guarantees to be a professional placing an order as part of their commercial activity. These GTCS are intended for professionals acting exclusively for purposes that fall within the scope of their professional activity. It is expressly recalled that the GTCS are only applicable to sales made to a professional buyer who acts for purposes that fall within the scope of their professional activity, no right of withdrawal exists for them.
To place an order, the Customer validates their cart and proceeds to payment in accordance with Article 7 above. A sales contract is formed between the Customer and the Merchant only upon receipt by the Customer of an order confirmation email at the email address provided by the Customer.
It is the Customer's responsibility to check the accuracy of the content of their order before validating their cart and proceeding with payment. The Customer can modify their cart before validating it and proceeding with payment of their order.
The Merchant reserves the right to refuse any order
The ordered products remain the property of the Merchant until payment of the order price and delivery by the Customer.
The transfer of risks takes place at the time of delivery of the order to the Customer.
In the event of non-conformity of the order at the time of delivery, the Merchant complies with its legal warranty obligations. The Customer acting as a consumer can contact customer service in accordance with article 7 above. The Customer must exercise their legal warranty within 2 months from the delivery of the order. They are free to request from customer service the replacement of the non-compliant order or the return of the order and the refund of the price of the defective products. In case of return, the Customer must explicitly inform the Merchant and return their entire order, in its original condition and in its undamaged original packaging, with all delivered accessories.
The Customer may contact customer service in accordance with Article 11 above if, at the time of delivery, defects are found in their order making the products unfit for use. The Customer may then request a price reduction from customer service or return their order to be reimbursed for the price of the defective products. In the event of a return, the Customer must explicitly inform the Merchant of their withdrawal and return the entire order, in its original condition and in its undamaged original packaging, with all delivered accessories.
In application of article L. 121-21 of the Consumer Code, the Customer acting as a consumer may withdraw without cause within fourteen (14) days from the date of receipt of the order.
In the case of an order for several goods delivered separately over a defined period, the period runs from the receipt of the last good or lot or the last item. If the deadline expires on a Saturday, Sunday or public holiday, the withdrawal period is extended to the next working day.
However, pursuant to Article L. 121-21-8 of the Consumer Code:
"The right of withdrawal cannot be exercised for contracts:
4° For the supply of goods liable to deteriorate or expire rapidly 5° For the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection 6° For the supply of goods which, after having been delivered and by their nature, are inseparably mixed with other articles"
In case of withdrawal, the Customer will receive a refund for their order, excluding any delivery costs for the return, by the same payment method used by the Customer for the purchase of the products, and under the conditions provided for in article 13 below. This refund will not include any return shipping costs.
In order to exercise their right of withdrawal, the Customer acting as a consumer must explicitly inform the Merchant of their withdrawal and return their entire order, in its original condition and in its undamaged original packaging, with all delivered accessories.
The Merchant cannot be held responsible for the non-performance or delay in the performance of its contractual obligations regarding the sale of products purchased on https://saranguerel.com in the event of an event beyond its control, a case of force majeure, or an act of a third party external to the Merchant's will.
It is agreed that force majeure events may include: legislative and regulatory changes, fires, storms, floods, internal or external strikes to the merchant, illness, power surges and electrical shocks, failures of cooling systems and computer equipment, blockages and slowdowns of electronic communication networks, viruses and computer hacking, and more generally any unforeseen event beyond the Merchant's control.
Article L. 612-1 of the Consumer Code states that "Any consumer has the right to free recourse to a consumer mediator with a view to the amicable resolution of the dispute between them and a professional."

This covers disputes relating to the execution of a sales contract or provision of services between a consumer and a professional.
Any dispute related to sales contracts for products purchased on https://saranguerel.com will be subject to the jurisdiction and laws of French law governing said sales contracts.
